Article 1 - Purpose and acceptance
These Terms of Use (hereinafter the « ToU ») define the rules governing the use of the hosting, infrastructure and related services provided by HG-HOSTING (hereinafter « HG-Hosting ») to the Customer identified in the client area or at the time of order. They supplement the Terms of Sale (ToS) and the Privacy Policy.
Creating an account, accessing the services or using them constitutes full and unreserved acceptance of the ToU in force. If the Customer refuses the ToU, they must cease all use and terminate their contract in accordance with the terms set out in article 12 of the ToS.
Article 2 - Definitions
« Service » means any resource or feature provided by HG-Hosting (web hosting, panel, API, game server, VPS, VDS, dedicated server, transit IP / anti-DDoS proxy, storage, databases, IP addresses, etc.). « Content » means any data stored, transmitted, displayed or made available by the Customer or their end users through the Service. « End user » means any person accessing the Customer's resources (players, website visitors, etc.). « Technical subcontractor » means any provider operating all or part of the infrastructure on behalf of HG-Hosting (in particular the DDoS mitigation operator Netrix, the transit operator(s), the physical hosting provider, etc.).
Article 3 - Acceptable Use Policy (AUP)
HG-Hosting applies a strict acceptable use policy in order to preserve the security, stability and reputation of its network as well as that of its customers. The Customer undertakes not to use the Services in a manner that would violate French and European law, nor the laws of the country from which they operate or towards which they target users.
3.1 - Strictly prohibited uses
The following are notably prohibited, without limitation:
- Network attacks and abuse: launching, participating in, facilitating or hosting denial of service attacks (DDoS), unauthorised vulnerability scans on third-party networks, sniffing, hijacking, address spoofing, or any activity aimed at compromising the availability or integrity of third-party infrastructure. Such acts may give rise to criminal liability (articles 323-1 et seq. of the French Penal Code).
- Malware and malicious code: hosting, distributing or relaying viruses, worms, Trojan horses, ransomware, cryptominers without the end user's consent, botnets, exploit kits, brute-force tools against external targets.
- Phishing and fraud: identity theft, phishing pages, fraudulent collection of banking data or credentials, financial scams, Ponzi schemes, unlawful MLM programmes.
- Warez and counterfeiting: distribution of pirated software, games, music, films or books, DRM circumvention, sale or sharing of licences not authorised by the rights holders.
- Spam and abusive solicitation: sending unsolicited bulk emails or messages that do not comply with the applicable regulations (opt-in, identification, unsubscribe), open relay, hosting of stolen address lists for prospecting purposes.
- Illegal content: glorification of crimes against humanity, incitement to hatred, violence, terrorism, child sexual abuse material (CSAM - see article 8 on cooperation with authorities), violation of human dignity, sale of prohibited products (weapons, narcotics, etc.) in breach of applicable law.
- Invasion of privacy: publication or processing of personal data without a legal basis, doxxing, unlawful surveillance, resale of breached databases.
3.2 - Mining, public proxies and anonymous relays
Unless otherwise agreed in writing in advance by HG-Hosting, the Customer shall refrain from using the Services for cryptocurrency mining on offers not intended for that purpose, from exposing open proxies to the public that could be hijacked for illicit activities, or from operating Tor exit relays without a specific contractual framework.
Article 4 - Game servers (Minecraft, FiveM, etc.)
4.1 - Customer responsibility
The Customer is solely responsible for the operation of their game server, the configuration of mods, scripts and resources (vehicle packs, maps, etc.), compliance with the terms of the publishers and rights holders (in particular Mojang/Microsoft for Minecraft, Rockstar Games and Cfx.re for FiveM, Facepunch for Rust, etc.), as well as the moderation of their community (chat, toxic behaviour, cheating). HG-Hosting does not control gameplay and does not act as the publisher of the game.
4.2 - Content and licences
The Customer warrants that they hold the necessary rights to the assets they integrate. Any report of infringing or unlawful content may lead to the immediate suspension of the service concerned, without refund, until the situation is regularised or the dispute is closed.
4.3 - Technical limits
The offers are subject to contractual limits (slots, concurrent player capacity for HG-Proxy, server tick rate, storage). The Customer undertakes not to attempt to circumvent these limits by unauthorised technical means.
Article 5 - Resource abuse (CPU, RAM, disk, bandwidth)
The Customer must use the allocated resources reasonably. Abnormal or excessive use affecting the stability of shared hosting nodes or the quality of service of other customers may be limited, throttled or interrupted without prior notice, then notified afterwards where the situation allows.
This notably includes: infinite loop processes saturating the CPU, uncorrected memory leaks, excessive disk I/O caused by poor database configuration, massive sending of outbound packets unrelated to legitimate use of the subscribed service, use of storage as a repository for personal backups outside the scope of the offer.
On offers with « burst », « fair share » or « Best Effort » resources (in particular the shared 10G uplink of HG-Proxy), HG-Hosting applies a fairness policy; the Customer acknowledges that prolonged spikes may be restricted when the aggregate capacity of the uplink is saturated.
Article 6 - Email and messaging
Where the Service includes messaging, the Customer must correctly configure SPF, DKIM and DMARC when provided, follow good sending practices, and not send messages to recipients who have not consented where the law requires it. Complaints sent to abuse@ or the equivalent of other operators must be handled within the communicated timeframes; failing this, HG-Hosting may suspend outbound sending.
Article 7 - Security, credentials and access
The Customer is responsible for keeping their credentials, API keys, tokens and passwords confidential. They must enable two-factor authentication when the client area offers it. Any operation carried out using the Customer's credentials is presumed to be their own, unless immediate notification of compromise is given with reasonable proof.
The Customer must not attempt to access the systems, accounts or data of other customers. Any intrusion or attempt may give rise to the criminal liability provided for in articles 323-1 to 323-7 of the French Penal Code. Security testing on HG-Hosting's infrastructure requires prior written authorisation (bug bounty or supervised audit).
Article 8 - Abuse reporting and cooperation with authorities
In accordance with the French law on confidence in the digital economy (LCEN, law no. 2004-575 of 21 June 2004) and law no. 2021-1109 of 24 August 2021, HG-Hosting maintains a dedicated address for reporting abuse:
Reporting address: abuse@hg-hosting.fr
Any notification must include, in accordance with article 6-I-5 of the LCEN: the date of notification; the identity of the notifying party; contact details; a precise description of the disputed facts and their location (URL, IP, service identifier); the legal grounds justifying the removal; a copy of the prior correspondence sent to the author or publisher of the content where this is required.
HG-Hosting may have to respond to reports from authorities, injured third parties or technical providers (in particular the PHAROS platform for terrorist or child sexual abuse content). The Customer undertakes to cooperate in good faith by providing the necessary information within reasonable timeframes. In the event of legal proceedings, HG-Hosting will carry out the measures required by law, including the retention and disclosure of logs under the conditions provided for by law.
Article 9 - Immediate suspension without notice or refund
For serious breaches of these ToU - including but not limited to: DDoS attacks, hosting of malware or phishing, mass spam, child sexual abuse material (CSAM), critical compromise of network security - HG-Hosting may immediately suspend, without prior notice, access to the Services concerned, and where applicable terminate the contract without refund of amounts already collected for the current period, without prejudice to damages if direct harm is established.
This measure aims to protect the infrastructure, other customers and third parties. In less urgent situations, a formal notice procedure may be followed in accordance with article 12.2 of the ToS (a period of fifteen (15) days after formal notice).
Article 10 - Stored content and "notice & takedown" procedure
In accordance with the French law on confidence in the digital economy (LCEN), HG-Hosting may remove or block access to manifestly unlawful content upon a substantiated notification. The official channel for sending a notification is abuse@hg-hosting.fr; the mandatory particulars of a valid notification are set out in article 8.
The Customer is informed of the removal where the law does not prohibit it and may contest it through the applicable legal remedies (amicable appeal to HG-Hosting, then judicial remedies).
Article 11 - Technical data and log retention
HG-Hosting collects and processes certain technical data (connection logs, server logs, security metadata) necessary for the provision, security and billing of the Services, as well as for compliance with its legal obligations.
The main retention periods are as follows, without prejudice to an extension at the request of a judicial authority:
- Connection logs (LCEN art. 6-II): retained for twelve (12) months from the creation of the content or the operation concerned.
- Application and security logs: between 30 and 90 days depending on criticality, in compliance with the data minimisation principle (GDPR art. 5).
- Billing data: 10 years (accounting obligations - art. L123-22 of the French Commercial Code).
The full terms (categories of data, purposes, legal bases, recipients, Customer rights) are detailed in the Privacy Policy.
Article 12 - Amendments to the ToU
HG-Hosting may amend the ToU to reflect legal, technical or commercial developments. The updated version is published on « hg-hosting.fr » with a date indication. For ongoing contracts, a notification is sent by email or via the client area; continued use of the Services after a period of fifteen (15) days constitutes acceptance, unless the Customer terminates within that period where the amendment is substantial and unfavourable.
Article 13 - Governing law and jurisdiction
The ToU are governed by French law. Disputes fall, subject to the mandatory provisions protecting consumers, within the jurisdiction of the competent French courts under the rules of ordinary law.
